When people purchase TNT Red, White, and Blue Smoke fireworks, they expect the product to emit patriotic smoke, just as the name suggests. They do not expect the product to explode when lit. Unfortunately, that is just what happened over the July 4th holiday weekend to several people in several states. Those in Ohio who have any of these fireworks will want to carefully follow the product recall instructions.
A settlement agreement has been reached to reimburse customers $553 million in order to facilitate recalls of the infamous Takata Corp. airbags. Takata has been a focal point of the largest safety recall in the history of the auto industry. The product recall settlement could affect customers in many states, including Ohio.
Products liability is a relatively new area of law and cause of action (a cause of action is a valid legal reason to hold someone accountable for some action or inaction). Products liability was created as a result of the mass production and sale of items. People were injured spread across the country. Unfortunately, because there are so many steps from raw material to finished product and eventually sold on a shelf, that there is no way the victim can ascertain which party is ultimately responsible. The result was that the various defendants would play a shell game, confounding victims and frustrating the administration of justice.
Millions of dehumidifiers are being recalled after they were found to be responsible for more than 450 fires. The company is also being accused of "misrepresenting" the problem to the Consumer Product Safety Commission; they said the dehumidifiers had caused $4.5 million in property damage. The real figure is closer to $20 million.
One of the scariest thoughts of many Americans is that of suffering through the aftermath of a medical mistake. In Ohio and other states, such mistakes are often made by doctors during surgery or pharmacists when packaging medications. One rarely thinks of a detrimental medical mistake being made by an orthopedics company. When a customer is implanted with a dangerous product, however, or has a defective product placed in them during surgery, that's exactly where the blame often falls.
The law that protects consumers from the consumption of unsafe or hazardous products is called the product liability law, which gives consumers the power to take legal actions against manufacturers. All products are required to meet consumer expectations and the consumer has the right to sue the company if the product leads to any kind of physical injury or inability to meet basic expectations.
Vehicles must always be safe to prevent any unfortunate incidents. Car manufacturers try to make sure that the vehicles they produce are free of all internal faults. But in some cases, it is impossible to know about certain flaws in the vehicle before it is shipped to the consumer. The car manufacturer could face serious product liability lawsuits if the vehicle or one of its parts malfunctions.
Manufacturers must provide sufficient warning to consumers if there is even a slight chance of injury when a product is used. Even if there are no flaws in the product, it could be considered defective if there are no clear instructions or warnings regarding the risks. Manufacturers should not let the product reach the consumer without clear safety instructions.
For many people, recalls are something they may hear about only a couple of times by chance, on the news or shared on Facebook. But the defective or at-risk products people inadvertently come across may not actually be recalls that are relevant to them. However, it is good habit to make a point of checking online for recalls at least a couple of times yearly in order to ensure you have not missed anything pertinent and possibly detrimental to you or your loved ones.

Many times, identifying the negligence that prompts a products liability lawsuit is extremely difficult. Fortunately, for individuals that have been injured by defective or dangerous products, there are experienced legal professionals that can help.
